Registration:

a) Before bidding, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you click the “Register to Bid” button, you enter into a binding agreement with Spokane Estate Buyers.

b) Registering to bid is free. You must provide a credit card during registration. This card will be charged for any items on which you are the successful high bidder. Charges will include the winning bid price, a 10% Buyer’s Premium, and 10% sales tax unless a valid sales-tax exemption applies.

Bidding:

a) All bids submitted are final and irrevocable, whether submitted in person, online, or by proxy. If you are the highest bidder, you are responsible for purchasing that item. All sales are final.

b) Most items are sold without reserves, minimums, or limits. Spokane Estate Buyers expressly forbids owners and their agents from bidding on items they have consigned to an auction. Any item with a reserve will be identified so bidders know that a reserve price must be met for the item to sell.

c) Spokane Estate Buyers reserves the right to refuse bids from any individual. A 10% Buyer’s Premium applies to each item purchased. No cash discount applies. Cash customers must pay for their purchases or contact us within 24 hours of the auction closing.

Condition of Items, Testing, and Descriptions:

a) All items are sold “as is, where is,” with all faults. All sales are final. No returns, refunds, or guarantees are offered concerning condition, functionality, completeness, or suitability, except as expressly stated in these terms or required by applicable law.

b) We do our best to test every item we reasonably can and state the results in its listing. Testing may be limited to basic functions and does not necessarily cover every feature, component, or operating condition. A statement that an item works describes only the testing performed and results observed; it is not a guarantee of continued performance. Items marked “untested” have not been confirmed to work. No testing or functionality beyond what is expressly stated should be assumed.

c) We describe each item to the best of our ability, but we are not perfect. Descriptions may contain errors or omissions and are not complete or exhaustive. Buyers must review both the written description and all available photographs before bidding. Photographs form part of the item description, although they may not show every defect. Items are offered only as described and pictured; no additional accessories, features, condition, or guarantees should be assumed.

d) Buyers are responsible for determining an item’s condition and suitability before submitting a bid. We recommend inspecting items before bidding when inspection is available. You may also arrange for someone to inspect an item on your behalf. Questions and requests for additional photographs should be submitted sufficiently before the auction closes to allow us time to respond.

e) No price adjustment will be made for damage, wear, missing parts, or other condition issues on items sold as is, except as required by applicable law.

Authenticity and Certificates:

a) Spokane Estate Buyers is NOT an authenticator and does not claim to provide professional authentication services. We identify and list items using the information available to us and our best understanding. Names, signatures, makers, brands, ages, origins, materials, and other attributions are our best identification and are not independently authenticated unless expressly stated.

b) Items without a COA (Certificate of Authenticity) cannot be guaranteed authentic and are labeled only to the best of our knowledge. Buyers must perform their own research before bidding.

c) If a COA accompanies an item, its presence and issuer will be identified to the best of our ability. The inclusion of a COA does not mean Spokane Estate Buyers has independently verified the item, certificate, signature, or issuing organization, and does not create an authenticity guarantee from Spokane Estate Buyers.

d) GEMSTONES: Spokane Estate Buyers does not guarantee the authenticity of gemstones or the accuracy or reliability of gemological reports or grading companies. Buyers are responsible for researching gemstones, reports, and grading companies before bidding. We will do our best to answer questions or provide additional photographs when requests are received sufficiently before the auction closes.

Appraisals and Opinions of Value:

a) Appraisal prices, auction estimates, and other stated values are provided as guidance only. Spokane Estate Buyers does not guarantee any opinion of value or any resale price.

b) Opinions concerning value, quality, and gemstone grading can vary based on market conditions, availability, geographic location, equipment, grading methods, and the evaluator’s training.

c) Any accompanying appraisal or certificate should be reviewed for its stated scope, issuer, and limitations. Spokane Estate Buyers does not independently verify its conclusions unless expressly stated. Items should not be purchased with the expectation of reselling them for the appraisal price or for a profit.

Responsibility and Ownership:

a) Every item becomes the responsibility of the successful bidder when the online auction concludes. Successful bidders are responsible for arranging any insurance they wish to obtain for their purchases.

b) Items at this point are all delivery or shipping ONLY. IF within 35 miles of Chewelah, WA we will do a flat $5.00 delivery plus $5.00 per large furniture item where it applies. Otherwise all items will be bundled together in one shipment so as to save on cost and done so at the cheapest cost we can. 

Payment:

a) Purchases must be paid in full via invoice sent by Square  within 3 days of end of auction. If not paid by this time you will be placed on a ban until you have facilitated payment. A 10% Buyer’s Premium and 10% sales tax apply unless a valid sales-tax exemption applies.

b) Items not paid for within three days of the auction concluding may be deemed abandoned and sold at a future along with ban put in place until your have made your payment regardless if the items are still available as they are deemed abandoned after 3 days time. Refunds will not be given on abandoned items. Items may be subject to a storage fee of $10 per lot per day. Prior arrangements may be made by contacting us ahead of time.

c) If Spokane Estate Buyers cannot make available or deliver clear title to a vehicle, the buyer is entitled to a full refund of the purchase price upon immediate return of the vehicle. The vehicle must be returned in the same condition as it was before the sale.

d) Resellers must submit a valid reseller permit or applicable resale exemption certificate before the auction concludes. Without valid exemption documentation, 10% sales tax will be charged without exception.

e) By bidding, buyers authorize charges to their registered credit card for purchases and applicable fees under these terms. This authorization does not waive rights that cannot lawfully be waived.

Acceptance of Terms:

Submitting a bid signifies your agreement to these Terms and Conditions. If you do not agree to or understand these terms, DO NOT BID.

Auction end times may be extended at any time for any reason.
